Terms of Service

Please read these Terms carefully before creating an account, purchasing access, or using the Service.

01Acceptance of These Terms

These Terms of Service ("Terms") are a binding agreement between you and The Last Detail ("The Last Detail," "we," "us," or "our"). They govern your access to and use of getthelastdetail.com, the guided organizer, account features, printable or downloadable materials, the Executor's Toolkit, optional integrations, and all related services we make available (collectively, the "Service").

The Last Detail is operated by Aundraya Ruse, a sole proprietor doing business as The Last Detail.

By creating an account, clicking or checking an acceptance box, purchasing access, accessing paid features, or otherwise using the Service, you represent that you have read, understood, and agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not create an account, purchase, or use the Service. If you use the Service for or on behalf of another person, you also represent that you are lawfully authorized to do so.

02The Service

The Service is a guided organizational and educational tool for end-of-life and family preparedness. It asks structured questions about matters such as household contacts, important documents, financial accounts, insurance and benefits, property, digital life, dependents, pets, personal wishes, and practical information that family members may need. It stores the answers you choose to provide, tailors portions of the organizer to your situation, displays completion information, and assembles your entries into materials that you may print or save.

The Service may provide prompts, examples, checklists, educational explanations, completion percentages, organizational summaries, and a general Executor's Toolkit. These features help organize information; they do not verify that the information is correct, current, complete, legally sufficient, or appropriate for your circumstances.

03No Legal or Professional Advice

The Last Detail is not a law firm and does not provide legal, tax, financial, investment, accounting, insurance, medical, mental-health, or other professional advice. Nothing in the Service creates an attorney-client, fiduciary, adviser-client, doctor-patient, or other professional relationship.

The Service does not create, draft, execute, witness, notarize, validate, amend, revoke, file, or replace a will, trust, codicil, deed, power of attorney, advance directive, living will, beneficiary designation, guardianship nomination, probate filing, tax election, insurance form, or other legal instrument. A generated or printed organizer is not itself a legal document, has no guaranteed legal effect, and does not override a properly executed legal instrument.

Estate-planning, probate, tax, beneficiary, incapacity, medical, and execution requirements differ by jurisdiction, change over time, and depend on individual facts. You should consult appropriately licensed professionals in your jurisdiction before making or changing legally significant arrangements. Do not delay emergency, legal, financial, or medical assistance because of anything presented through the Service.

04No Guarantee of Preparedness

A completion percentage, progress indicator, label, checklist, summary, or statement such as "complete" describes only activity within the Service. It is not a professional assessment or representation that your affairs are organized, your estate plan is valid, your beneficiaries are correctly designated, your taxes are addressed, your family can access every asset, or any person is prepared to administer your affairs. You remain responsible for independently reviewing your circumstances and updating both the organizer and any separate legal or financial documents.

05Eligibility and Personal Use

You must be at least 18 years old, have legal capacity to form a binding contract, and use the Service only for lawful personal or household purposes. The Service is not intended for use by law firms, financial institutions, healthcare providers, fiduciaries, or other businesses to manage client records unless we separately agree in writing.

The Service is directed to users in the United States. You are responsible for determining whether access or use is lawful where you are located.

06Information About Other People

The organizer may allow you to enter information about family members, children, dependents, contacts, advisers, employers, beneficiaries, executors, guardians, caregivers, and other people. You may enter another person's information only when you have a lawful basis and any permission reasonably necessary to do so, and only to the extent relevant to your organizer.

Do not impersonate another person, create an account for another adult without authority, or represent that the Service verifies your status as an agent, attorney-in-fact, guardian, executor, trustee, personal representative, or fiduciary. You are responsible for notifying other people about your use of their information where applicable.

07Accounts and Account Security

You must provide accurate account information and keep it current. You are responsible for safeguarding your sign-in credentials, email account, devices, and any printed or downloaded copies. Do not share access with a person who should not see your organizer. Notify us promptly at support@getthelastdetail.com if you suspect unauthorized access, loss of credentials, or a security incident involving your account.

You are responsible for activity through your account except to the extent caused by our failure to comply with these Terms or applicable law. We may require reasonable verification before assisting with account access, export, correction, or deletion.

08Purchase, Price, and Payment

Paid access is currently offered for a one-time payment of \$47 USD unless a different price is clearly displayed before purchase. There is no subscription, recurring charge, or automatic renewal. Lemon Squeezy acts as merchant of record and processes the transaction, payment details, applicable taxes, and refunds under its own terms and privacy notice. We do not receive or store your complete payment-card number.

You authorize the applicable charge when you submit an order. Prices, promotions, taxes, and available features may change prospectively, but a price change will not create a recurring charge. You are responsible for providing accurate purchase and billing information.

09Scope and Duration of Access

A purchase grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to access the paid features while we operate the Service, subject to these Terms. The purchase does not transfer ownership of the Service or promise permanent hosting, permanent data storage, uninterrupted availability, unchanged features, or access for your lifetime.

Statements such as "pay once," "no subscription," or "yours to keep and update" mean that we do not charge a recurring access fee for the purchased features while the Service remains operational. They do not mean that the hosted Service will operate forever. Print or save a current copy of your organizer regularly and whenever you make an important update.

10Refund Policy

You may request a full refund by emailing support@getthelastdetail.com within 14 calendar days after purchase. No reason is required. Refunds are processed through Lemon Squeezy to the original payment method, and paid access ends when the refund is processed. After 14 days, refunds are discretionary unless applicable law requires otherwise. This refund policy does not restrict any non-waivable consumer right.

11Your Content

As between you and us, you retain ownership of the information, text, and materials you submit to the Service ("User Content"). You grant us a limited, worldwide, non-exclusive, royalty-free license to host, copy, transmit, process, organize, format, display, and generate materials from User Content only as reasonably necessary to operate, secure, maintain, support, and improve the Service, fulfill your requests, enforce these Terms, and comply with law.

This operational license ends when the relevant User Content is deleted from active systems, except for residual backup copies, de-identified information, security records, transaction records, and information retained as required or permitted by law and described in the Privacy Policy.

You are responsible for the accuracy, legality, relevance, and consequences of User Content and for reviewing every generated document before using or sharing it. We do not monitor, verify, update, correct, or independently preserve the information you enter.

12Information You Must Not Enter

Do not enter passwords, passcodes, PINs, private keys, recovery or seed phrases, full bank-account numbers, full payment-card numbers, complete Social Security numbers, complete government-identification numbers, safe combinations, alarm codes, or other credentials that directly unlock an account, asset, premises, or device. Use a document location, institution name, contact person, or last four digits where prompted.

The Service is designed not to request those items. If you disregard this restriction, the information may be stored as User Content until you remove it or delete the account. You assume the additional risk created by submitting prohibited information, but this provision does not waive duties that applicable law places on us. We may remove prohibited content when reasonably necessary to protect users or the Service.

13Acceptable Use

You must not: (a) violate law or another person's rights; (b) submit information without lawful authority; (c) access or attempt to access another user's account or data; (d) probe, scan, test, disrupt, overload, or bypass security or access controls; (e) introduce malware or harmful code; (f) scrape, copy, or harvest the Service by automated means except as expressly authorized; (g) reverse engineer or attempt to derive source code except where law prohibits this restriction; (h) resell, sublicense, or commercially exploit the Service; (i) misrepresent the Service as professional advice or a legal document; or (j) use the Service to harm, deceive, threaten, stalk, or exploit anyone.

14Optional Third-Party and AI Integrations

The Service may offer optional connections to third-party products, including an AI assistant. An optional integration is activated only at your direction. Before information is transmitted, the Service should identify the provider, the relevant data flow, and the requested function. Information you elect to send is processed by that provider under its own terms and privacy practices.

Do not transmit prohibited credentials or highly sensitive identifiers through an integration. AI-generated content may be inaccurate, incomplete, outdated, or unsuitable and must not be treated as professional advice. We do not control third-party services and are not responsible for their independent acts, omissions, outages, security, or policy changes, except to the extent applicable law provides otherwise.

15Our Intellectual Property

The Service and its software, design, selection and arrangement, prompts, question structure, educational text, graphics, logos, trademarks, and non-user content are owned by or licensed to The Last Detail and protected by intellectual-property laws. Except for the limited access right granted in these Terms and your right to retain your own generated organizer for personal use, no license or ownership right is transferred.

If you voluntarily provide ideas or feedback, you grant us a perpetual, worldwide, royalty-free right to use it without restriction or compensation, provided that we do not publicly identify you or disclose your User Content without permission.

16Availability, Changes, and Discontinuation

We may maintain, update, improve, add, modify, suspend, or remove features. The Service may be unavailable due to maintenance, outages, security events, provider failures, or circumstances beyond our reasonable control. We do not promise uninterrupted availability or permanent storage.

If we decide to discontinue the Service as a whole, we will use reasonable efforts to give at least 60 days' notice by email and keep printing or export available during that period. This commitment does not apply when security, legal, technical, provider, or emergency circumstances make notice or continued access impracticable. After closure, information will be deleted or retained in accordance with the Privacy Policy and ordinary backup cycles.

17Suspension and Termination

You may stop using the Service and delete your account at any time. We may restrict, suspend, or terminate access when we reasonably believe that you violated these Terms, used the Service unlawfully, failed to pay, created a security risk, or exposed us or another person to legal harm.

When reasonably practicable, we will notify you and permit export before termination. We may act immediately to prevent unauthorized access, security harm, fraud, or legal exposure. If we terminate paid access without cause within 14 days after purchase, we will provide a refund. Sections that by their nature should survive termination will survive, including intellectual-property, disclaimer, liability, dispute, and general provisions.

18Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL GENERATED MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SECURITY, AVAILABILITY, AND RESULTS.

WE DO NOT WARRANT THAT THE SERVICE WILL IDENTIFY EVERY MATTER RELEVANT TO YOU, SATISFY ANY LEGAL OR PROFESSIONAL REQUIREMENT, PREVENT LOSS, REMAIN AVAILABLE WHEN NEEDED, OR PRODUCE A DOCUMENT SUITABLE FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO THESE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

19Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE LAST DETAIL AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, OPPORTUNITY, GOODWILL, OR DATA; OR LOSSES ARISING FROM RELIANCE ON THE SERVICE, FAILURE TO OBTAIN PROFESSIONAL ADVICE, INACCURATE OR OUTDATED USER CONTENT, A USER OR FAMILY MEMBER'S DECISION OR OMISSION, OR DELAY IN LOCATING INFORMATION.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) \$100.

These limitations do not apply to liability that cannot legally be excluded or limited, and they do not excuse a failure to use safeguards required by applicable law. Your payment obligations and remedies for unauthorized or unlawful use are not limited by this section.

20Responsibility for Misuse

To the extent permitted by law, you are responsible for third-party claims, losses, and reasonable costs directly caused by your intentional unlawful use of the Service, your unauthorized submission of another person's information, or your material violation of Section 13. This section does not require a consumer to indemnify us for our own negligence, willful misconduct, or violation of law.

21Informal Dispute Resolution

Before filing a claim, the complaining party will send a written description of the dispute, supporting facts, and requested relief to the other party. Notices to us must be sent to support@getthelastdetail.com with the subject "Legal Notice." The parties will allow 30 days for a good-faith attempt to resolve the dispute informally. This requirement does not prevent a party from seeking urgent injunctive relief, using an available small-claims procedure, contacting a regulator, or filing in time to preserve a limitation period.

22Governing Law and Forum

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to non-waivable law and any available small-claims jurisdiction, an action arising out of or relating to these Terms or the Service must be brought in a state or federal court of competent jurisdiction in Texas, and each party consents to personal jurisdiction there.

Nothing in these Terms limits a non-waivable right or remedy under the consumer-protection law of your place of residence.

23Changes to These Terms

We may update these Terms prospectively to reflect changes in the Service, law, security, or business practices. We will post the revised Terms and update the effective date. If a change materially affects existing users' rights or obligations, we will provide reasonable advance notice by email or within the Service and obtain consent where required. A revision will not retroactively change the terms applicable to a dispute that arose before its effective date. Continued use after the effective date constitutes acceptance where permitted by law.

24Electronic Communications

You consent to receive account, purchase, security, support, policy-change, discontinuation, and other transactional notices electronically. You must keep your account email current. Marketing communications, if any, will include legally required opt-out choices and are not a condition of purchase. Electronic notices satisfy any writing requirement to the extent permitted by law.

25General Provisions

These Terms and the Privacy Policy constitute the entire agreement concerning the Service, except for additional terms presented for a specific feature or transaction. If a provision is held unenforceable, it will be modified only to the minimum extent necessary and the remainder will remain effective. A waiver must be express and does not waive a later breach.

You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, reorganization, financing, or sale of all or part of the business, subject to applicable law. Headings are for convenience. These Terms do not create a partnership, joint venture, agency, employment, fiduciary, or franchise relationship.
